This is an email with an attached memo from Duxbury Town Counsel Robert Troy to Duxbury Town Manager Richard MacDonald sent on December 1, 2008. It is one of many emails turned over by Troy’s attorneys on September 29, 2012 in response to a subpoena by Duxbury’s current lawyers in the case that Troy’s tried unsuccessfully to have quashed.
In the attached memo, Troy notes that there are some issues with the original bidding process but goes on to tell MacDonald how he can fix that and go ahead and award the bid.
That is not, however, what the Town of Duxbury did.
The result, nearly four years later, is that Duxbury’s taxpayers are now on the hook for well over a million dollars of damages to Johnson Golf Management (that is not covered by any insurance and will have to come out of more increases in real estate tax bills — on top of all the other increases already about to be imposed after Duxbury’s recent $100+ million capital spending spree).
